Supreme Court refers Aadhar card matter to Constitution Bench

The Supreme Court today referred to a Constitution Bench a batch of petitions challenging the Centre's ambitious scheme to provide Aadhar card to all citizens and decide whether right to privacy is a fundamental right.

Allowing the Centre's plea, a three-judge bench comprising Justices J Chelameswar, S A Bobde and C Nagappan, framed various questions, including as to whether right to privacy is a fundamental right, to be decided by the larger Constitution Bench.

"If yes, then what would be contours of the right to privacy," the apex court said while referring the matter to Chief Justice H L Dattu for setting up the larger bench.

Attorney General Mukul Rohatgi, appearing for the Centre, had earlier said that the matters requires elaborate debate and an authoritative pronouncement in view of the fact that there have been inconsistent decisions as to whether right to privacy is a fundamental right.

He had cited two judgements, pronounced by six and eight- judge benches, which had held that right to privacy is not a fundamental right.

Subsequently, smaller benches had held contrary view and, hence this matter needed to be decided by a larger bench, AG had said.

"Whether right to privacy is a fundamental right guaranteed under Part III of the Constitution of India, in the light of express ratio to the contrary by an eight-judge bench in M P Sharma case and also by a six-judge bench of this court in Kharak Singh's case" has to be decided, he had said.

Earlier, the Centre had sought transfer of pleas against Aadhar to a larger bench, saying that a two-judge or a three- judge bench cannot decide it.

Referring to pronouncements made in historic cases like A K Gopalan, Maneka Gandhi and bank nationalisation, the top law officer had said that inconsistencies with regard to interpretation of certain fundamental rights can only be "squared up" by a larger bench.
Earlier, the government had opposed a plea seeking initiation of contempt proceedings against it, Reserve Bank of India (RBI) and others for allegedly insisting on Aadhar cards to grant benefits of various schemes to citizens, saying it was not mandatory.

In pursuance of earlier orders, the Centre has conveyed to states and authorities concerned not to make Aadhar cards, issued by Unique Identification Authority of India (UIDAI), mandatory for availing various schemes, Additional Solicitor General Pinky Anand had told the court.

The bench is hearing a batch of pleas against decisions of some states to make Aadhar cards compulsory for a range of activities including salary, provident fund disbursal, marriage and property registration.


The government had also said that persons, having Aadhar cards, were being asked to provide it to authorities but this was optional.


Senior advocate Gopal Subramanium, appearing for Mathew Thomas, one of the PIL petitioners, had filed an application seeking initiation of contempt proceedings against the Centre and others, including RBI, and the Election Commission.

He had alleged that the government and others were in violation of earlier orders that had said that no person should be denied any benefit or suffer for not having Aadhar cards.

Pensioner needs to know and provide his/her Aadhaar Number, PPO Number, Bank Account number and branch detail, Name, Address etc

5. How Do I Register For A Digital Life Certificate?
Pensioner’s information like Pension Aadhaar number, Pensioner Name, PPO Number, Bank Account detail, Address, Mobile number etc are fed into the system though web based / client interface and finally pensioners person information are authenticated using the Aadhaar number and pensioner has to put his finger on to the finger print scanner or eye on the Iris scanner.

After successful authentication, Pramaan ID / the transaction number is displayed on the screen and same has is sent to Pensioner’s mobile as SMS from the portal.

The portal generates Electronic Jeevan Pramaan for the successfully authenticated pensioner and it is stored in the central Life Certificate Repository database.

The disbursing Bank can access and get the Jeevan Pramaan certificate from the portal for his pensioners though the electronic data transfer mechanism created between the portal and Bank server.
Pensioner has to inform to the Bank that his Jeevan Pramaan has been generated through online registration from Jeevan Pramaan portal.

6. Is This Certificate Valid?
Yes, Digital Life Certificate is a valid certificate and recognized under the IT Act. The system benefits the pensioner from having to go before the Pension disbursing Authority to prove that he/she is alive.

Aadhaar is adequate to open a bank account: RBI

The Reserve Bank of India’s committee on comprehensive financial services for small businesses and low-income households headed by Nachiket Mor on Friday said that the Aadhaar process was adequate to enable every Indian to get a bank account by January 1, 2016.

“Target is dependent on our perception of what is happening to Aadhaar. The bank account target is really an electronic target, as we have articulated it. The big task in really opening a bank account is verifying all the documents and the customer. This is all being done by Aadhaar. The thought was that banks make use of the verification being done by Aadhaar. As soon as an Aadhaar is issued, only an instruction has to be issued to a willing bank to go ahead and open an account. So, opening the account should not be a difficult task unless you argue that Aadhaar accounts will not be done by 2015,” said Mr. Mor, while addressing a press conference here.

“We had discussion with Nandan Nilekani also….. So, we fixed January 1, 2016, as a target,” said Mr. Mor adding, “if you think of it as an independent process, where banks have to go back and open these accounts, it will take a longer time. It also takes Rs.200-300 to open an account otherwise.”

The committee, while laying down its vision statement for financial inclusion and deepening, has suggested providing a universal bank account to all Indians above the age of 18 years by January 1, 2016. He said that the account opening process should be totally automatic and free. “But people will be happy to pay the money if you give them the service.”

Obtaining Aadhar card optional, not mandatory: Centre tells SC


The Centre today told the Supreme Court that securing Aadhar cards, being issued by Unique Identification Authority of India (UIDAI), was optional and it has not made it mandatory for the citizens.

The apex court, hearing a batch of pleas against decisions of some states to make Aadhar cards compulsory for a range of activities including salary, PF disbursals and marriage and property registrations, asked the Centre not to issue it to illegal immigrantsas it would legitimise their stay.

The counsel for UIDAI and Centre responded to the pleas of petitioners, saying, "So far as the Union of India is concerned, we have said the Aadhar card is voluntary."

During the brief hearing, the bench of justices B S Chauhan and S A Bobde was told that despite the fact that the Aadhar card is "voluntary" in nature, an order has been issued by the Registrar of the Bombay High Court in pursuance of an order of the state government that it would be necessary for disbursal of salary of judges and staff also.

"The scheme is complete infraction of Fundamental Rights under Articles 14 (right to equality) and 21 (right to life and liberty). The government claims that the scheme is voluntary but it is not so.

"Aadhar is being made mandatory for purposes like registration of marriages and others.Maharashtra government has recently said no marriage will be registered if parties don't have Aadhar cards," senior advocate Anil Divan, arguing for Justice (retd) K S Puttaswamy, former judge of Karnataka High Court, said.

Justice Puttaswamy, in his PIL, has also sought a stay on the implementation of the scheme.

Making Aadhar mandatory for various purposes raises questions over the government's authority to implement such types of the scheme, it said, adding it also highlighted "the perils of the manner of its implementation".

The Centre has said the consent of an individual was indispensable for Aadhar and it has been launched to "promote inclusion and benefits of the marginalised sections of the society that has no formal identity proof."

Cut away portion, e-Aadhaar valid proofs of identity, address: UIDAI

NEW DELHI: In a bid to allay concerns of stakeholders on the validity of e-Aadhaar and cut-away portion of Aadhaar letter, UIDAItoday said either of the two will be considered a valid proof of identity and address. 

The Unique Identification Authority of India(UIDAI) which is implementing the Aadhaar project clarified in a statement that both--e-Aadhaar and cut-away portion of Aadhaar letter, is to be considered as a valid proof of identity and address. 

The Information Technology Act, 2000 provides for legal recognition of electronic records with digital signatures. Hence e-Aadhaar is to be treated as a valid document in view of the fact that it has been digitally certified, the authority said in statement. 

According to the UIDAI, the e-Aadhaar document is digitally signed, using certificate issued byNIC as per the IT Act

Further, all the data printed in e-Aadhaar is the same data as printed in Aadhaar letter, making it a valid and secured electronic document, which should be treated at par with a printed Aadhaar letter. 

A "Resident Portal" had been launched to enable the residents download their e-Aadhaar, an electronically generated Aadhaar letter, from the website of UIDAI. 

In addition, Common Service Centres, set up in states, are also catering to the needs of the residents with regards to download and printing of e-Aadhaar. 

UIDAI has been receiving complaints from residents regarding refusal of acceptance of cut away portion of Aadhaar letter as a valid document, it stated. 

The authority said the cut away portion of Aadhaar letter is as an officially valid document as it contains all the details of Aadhaar letter such as name, address, Aadhaar number, photograph and logo of the Aadhaar Project. 

It also carries a quick response (QR) code containing the demographic details of the resident, it added.

Operational Procedure: -

1.     Download Rename executable(*.exee) file as setup.exe and install KYC tool.
2.     Install and create database.
3.     Click Configuration button to configure server details.
4.     Click Initialize Button to Initialize KYC Number.
5.     Enter account number (Select Category) and press F8 to fetch details from Post database.
6.     Select Proof type enter Proof ID (In case of Joint - A or Joint - B enter 2nd Person's ID).
7.     Press F10 to Save details.
8.     Various filters are available under view button to sort data accordingly.
9.     Search Link is provided to search account by Name and by address and by Opendate in Post Database.
10.   Under View button all accounts with Adhar Card No. can be seen.

Insurance coverage to BPL Aadhar Card Holder.

Government of India is implementing two Social Security Insurance Schemes for the benefit of weaker and vulnerable sections of the society, through the Life Insurance Corporation of India (LIC). These are Aam Admi Bima Yojana (AABY) and Janashree Bima Yojana (JBY). Both Schemes provide insurance cover for a sum of Rs.30,000/- on natural death, Rs. 37,500/- on partial permanent disability due to accident and Rs.75,000/- on death or total permanent disability due to accident. Central Government contributes 50% premium as subsidy. 

This was stated by the Minister of State for Finance, Shri Namo Narain Meena in a written reply to a question in the Lok Sabha today.

While issue of Aaadhaar card with unique identification number of is in full pace, UIDAI which is executing Aadhaar Scheme throughout India has recently launched another online feature in its website (www.uidai.gov.in)

Those who have been issued with Aadhaar Card can now use the new online feature in UIDAI website to update their personal profile such as name, gender, date of birth, address and mobile number. Once any of these personal details of a Aadhaar Card holder is edited online, changes will be effected in the central Aadhaar database after due verification of hard-copies of documents concerned by UIDAI authorities
This feature is the most wanted one as demographic profie an individual who has been issued with Aadhaar Card such as mobile phone number, residential address etc may change after issue of Aadhaar card.

Aadhar without Date of Birth – Could not be used as sole document for ID proof

The Government’s initiative to issue identification cards (Aadhar) with unique identification number (UID) to all citizens of India is really a mammoth work considering the population in India.
As per the statistics issued about Aadhar, Unique Identification Authority of India (UIAI) has spent more than Rs.2000 crores for issuing Aadhar to nearly 23 crore people.
As such the Aadhar system is stated to be one of the full-proof technology to prevent duplication.  Three biometric attributes i.e face, fingerprints and iris images of the card holder are collected to maintain uniqueness.
Government has also taken all steps to officialize Aadhar Card for its acceptance an identification card by all government as well as private authorities.
Railways has already notified Aadhar as an acceptable identification card. But Banks say Aadhar alone is not enough for opening new account as it does not contain date of birth.
However, for opening a new account Banks are not accepting Aadhar alone as a documentary proof for the reason that date of birth of the card holder is not mentioned in Aadhar.  Hence,Banks insist additional documents such as PAN to verify the date of birth.
Aadhar is supposed to eliminate an individual’s difficulty of carrying multiple identification documents.  But in this case Aadhar is not alone enough as it could not produced as a document for certifying one’s age.
Better late than never:  Many feel, mentioning date of birth in Aadhar would
not be a problem as UIAI collects date of birth of an individual in the initial application itself.  In fact the year of birth is mentioned in Aadhar.

A look at the six most asked questions on UID

For more than 4 years, the 12-digit number called Aadhaar has generated more debate than action.
But now that 18 crore Indians do have this number and 42 crore more should have it by April 2013, it's time to focus more on what the number will—and can—really do.
For, it is the utility of the card that will make all the struggle in its implementation worthwhile—or worthless.
Here's a look at the six most asked questions on UID
1) What is Aadhaar authentication ? Is an individual's right of privacy ensured? 

Aadhaar authentication is a process through which the number, along with other attributes (demographics , biometrics or One-Time Pin), is submitted to UIDAI's Central Identities Data Repository (CIDR) for verification ; the CIDR verifies whether the data submitted matches the data available in CIDR and responds with a "yes/no" . No personal identity information is returned as part of the response.
2) When do I need to authenticate?
Service providers, such as the government for PDS and NREGA or banks, are expected to link Aadhaar authentication to their services. Residents would need to authenticate either at the time of subscribing to the service or at the time of availing service delivery. Then no one else can avail the benefits meant for a particular resident.

3) How will children be captured in the database?
No biometrics for children below 5 years; their UID will be processed on the basis of demographic information and photograph linked with their parents' UID. Once they are five years old, they need to be re-enrolled with biometrics of 10 fingers, iris and photograph. Biometrics will be updated once they turn 15.
4) What about biometrics of the differently-abled and people with no finger prints or those without fingers?
Biometric standards prescribed will ensure that these groups are not excluded. In the case of people without hands/ fingers only photo will be used for identity determination and there will be markers to determine uniqueness.
5) How will an Aadhaar-enabled bank account help a resident who already has a bank account?
The resident can link existing bank account to Adhaar as disbursement of social security benefits like pensions, scholarships or MGNREGS wages would only be through Aadhaar-enabled accounts.
UIDAI is working with states and central ministries to designate Aadhaar-enabled accounts for disbursal of all social security benefits. The individual would be able to access Aadhaar enabled bank account through a low-cost micro-ATM network which will have large geographical reach. Instant payments through biometric authentication and mobile payments will also be enabled in the future for such accounts.
6) What are micro-ATMs ? How will they work in the Aadhaar system?
Micro-ATMs are biometric authentication enabled hand-held device (also known as a Point of Transaction terminal). They will primarily allow the following functions: cash withdrawal, cash deposit, balance enquiry and remittances . These devices will be operated by business correspondents (BCs) appointed by banks.
The physical currency would be handled by this BC and not a machine like a regular ATM. All transactions will require online biometric authentication with the UIDAI authentication server in order to be processed.

Govt. gives nod to project merging Aadhar, PAN databases

In order to weed out the problem of fake PAN cards and to ensure an accurate biometric data, the government has initiated a mammoth project to bring together both the Aadhar and the PAN databases.

The Nandan Nilekani-led Unique Identification Authority of India (UIDAI) issues the Aadhar number which is now being synchronised with the Permanent Account Number database maintained by the I-T Department.

The Finance Ministry, which had first mooted the proposal of generating and issuing biometric PAN in 2006, had kept the decision pending for sometime as it was felt that both the agencies (UIDAI and I-T) would be “duplicating the effort” to reach a common goal — biometrics-based identity.

“It has been decided to integrate both the Aadhar and the PAN database which will help the agencies to maintain a correct database for ensuring two things.

While the Aadhar will ensure effective disbursal of government schemes to citizens, the biometric PAN card database will help stop the forgery of PAN cards which begets economic crimes,” a senior Finance Ministry official said.

The Finance Ministry, under the then Finance Minister P. Chidambaram in 2006, had proposed that the biometric PAN cards would have the I-T assesses’ fingerprints (two from each hand) and the face.

This will now be achieved by collating the Aadhar database with that of the PAN.

3.86 crore Aadhaar cards in process of being delivered: Government


The government today said as many as 3.86 crore Aadhaar letters are in the process of being dispatched while 6.46 lakh cards could not be delivered by the postal department due to various reasons such as incomplete address. 
As on April 20, 2012 a total of 17 crore Aadhaar numbers had been generated and 10.44 crore have been dispatched, Minister of State for Planning Ashwani Kumar said in a written reply in the Lok Sabha. 

"Out of these (10.44 crore letters), 6.58 crore Aadhaar letters have been delivered as reported by India Post and the remaining 3.86 crore letters are in transit," Kumar, who is also Minister of State for Science and Technology and Earth Science said. 

He further said that as per the portal of the Department of Posts, the total returned letters as on April 20, 2012, stood at 6.46 lakh. This is 0.98 per cent of total Aadhaar letters delivered. 

"There are five reasons for returned letters -- refused, deceased, insufficient address, addressee cannot be located and unclaimed," he said adding there was no bogus Aadhaar registrations. 

"The letter being returned are having clear remarks of the concerned postman of the area and they are one of the five mentioned reasons...," he said. 

Mandate of UIDAI is to issue Aadhaar numbers to all residents of India. 

Aadhaar aims to provide a identity infrastructure which can be used to improve delivery of public services.

Enrolments for Aadhaar in Phase-II set to begin this month

The UIDAI is all set to begin its second phase of enrolments for Aadhaar for 40 crore residents in April 2012. A National Level Workshop for Ecosystem partners including Registrars, Enrolment Agencies and other partners were launched at Vigyan Bhavan today.

 Enrolment for Aadhaar is expected to begin gradually across the country and UIDAI hopes to cover 40 crore residents in the coming 2 years with the active support and involvement of its eco-system partners. The Cabinet Committee on UIDAI had approved the continuation of Aadhaar enrolments by Unique Identification Authority of India (UIDAI) through multiple Registrars for an additional 40 crore
residents in January, this year. On this occasion Chairman, UIDAI, Shri Nandan Nilekani encouraged and asked the eco-system partners to actively participate in the next phase of Aadhaar enrolment, in line with the refresh strategy. The DG & MD, UIDAI, Shri RS Sharma highlighted some of the key lessons of the first phase of Aadhaar enrolment and showed the path for the next phase. The workshop was organised to take stock of various aspects of enrolments of Phase I (20 crore residents) and share with the Registrars and other partners, the "refresh strategy" before embarking on the second phase of enrolments. Some of the highlights of the ‘Refresh Strategy’ that were discussed during the workshop were-continuation of enrolment through multi-registrars, sweep approach to cover maximum number of residents of district/State, review of master data for pin code validation, amongst others, identification and training of Verifiers/Introducers by Registrars, on-line appointments for enrolments, setting up of Permanent enrolment stations at District/Taluk level in States/UTs that have covered majority of their population, development of enrolment plans by Registrars and Enrolment Agencies etc. The day long workshop was anchored by Shri Anil Khachi, DDG, UIDAI and he requested the Registrars to launch special social inclusion drives to cover marginalised sections of society.

What is Aadhaar?


Aadhaar is a 12 digit individual identification number issued by the Unique Identification Authority of India on behalf of the Government of India.
This number will serve as a proof of identity and address, anywhere in India.
Any individual, irrespective of age and gender, who is a resident in India and satisfies the verification process laid down by the UIDAI can enrol for Aadhaar.
Each individual needs to enroll only once which is free of cost.
Each Aadhaar number will be unique to an individual and will remain valid for life. Aadhaar number will help you provide access to services like banking, mobile phone connections and other Govt and Non-Govt services in due course.

Double boost for Aadhaar: funds and PM's endorsement

The ambitious and controversial Unique ID scheme — Aadhaar — received a double boost in this year's budget: not only did Finance Minister Pranab Mukherjee sanction Rs. 1,758 crore to enrol 40 crore more residents, but Prime Minister Manmohan Singh also emphasised that the scheme would soon become the main channel through which people could access a wide variety of budget benefits.

“I propose to allocate adequate funds to complete another 40 crore [beyond the existing 20 crore] enrolments starting from April 1, 2012,” said Mr. Mukherjee in his budget speech. “The Aadhaar platform is now ready to support the payments of the Mahatma Gandhi National Rural Employment Guarantee Act; old age, widow and disability pensions; and scholarships directly to the beneficiary accounts in selected areas.”
He outlined the pilot projects that have already started using Aadhaar to validate PDS ration cards and reduce leakage in LPG and kerosene subsidies through direct transfers. He claimed that substantial economies in subsidy outgo could be achieved through the Unique ID scheme.
