Compassionate appointment - Clarification regarding regulation of conditions and admissibility of various allowances after implementation of 6th CPC recommendation

Subject : Compassionate appointment - Clarification regarding regulation of conditions and admissibility of various allowances after implementation of Sixth CPC recommendation - regarding.

The undersigned is directed to refer to this Department's O.M. of even number dated 11.12.2009 on the subject mentioned above and to state that large number of references have been received from various Ministries/Departments regarding regulation of various conditions on compassionate appointment and admissibility of different allowances allowed to person appointed on compassionate grounds. Doubts raised by various authorities have been processed in consultation with Department of Expenditure (I.D. No. 22/02/2009-IC-II dated 27th February, 2012) and are  clarified as under :-

1. What will be Status of Trainee? A person appointed as 'Trainee' enjoys the status of a Government servant from initial day and will be allowed all the allowances and benefits allowed to a government servant.
2. What will be the maximum time period allowed for a person appointed as 'Trainee' to acquire minimum education qualification? A person appointed as a 'Trainee' on compassionate grounds has to acquire minimum educational qualifications in 5 years.
3. Whether belated case of compassionate appointments against the erstwhile Group 'D' posts can be considered now after regularization of all Group 'D' employees as group 'C' employees.? The belated case of compassionate appointment are be considered as per the revised recruitment rules for the MTS posts.
4 Whether a person appointed on compassionate grounds as 'Trainee' will have probation period.? The probation period of a person appointed as 'Trainee' on compassionate ground will begin only from the date he/she acquires minimum educational qualification and such person will be on probation for a period specified in the Recruitment Rules of the post/grade against which he/she is being appointed.
5 Whether Earned Leave, Half pay leave and other types of leave as applicable to regular Government employees would be allowed to a person appointed as 'Trainee' on compassionate ground? A 'Trainee' appointed on compassionate ground is entitled to all kinds of leave applicable to a regular government servant.
6 Whether Medical facilities/ Benefit of CGEGIS/VGHS on deduction of subscription for these schemes. Patient care allowance is allowed to a person appointed as 'Trainee' on compassionate ground? A person appointed as 'Trainee' on compassionate grounds is eligible to avail Medical facilities/Benefit of CGEGIS/CGHS available to holder of post in the pre-revised pay scale of Rs.4440-7440/- without any grade pay.
7 Status of payment of abort/long term advances as applicable to regular government servants to a person appointed as 'trainee' on compassionate ground? A 'Trainee' appointed on compassionate ground may be granted, by the competent authority, shorty term advances, with advances of pay recoverable in not more than 3 installments and advance of traveling allowances, festival advances, advances of in lieu of leave salary and advances of purchase of bicycles, warm clothing and table fans without production of surety, provided that such authority is satisfied that the same could be fully recovered or adjusted during the period of temporary employment of the said government servant concerned. In case of all other advances, a 'Trainee' would be required to procedure surety from a permanent central government servant, the surety bond being cancelled in the event of their confirmation in the permanent post.
8 Applicability of Leave Travel Concession to a person appointed as Trainee' on compassionate ground. A Trainee' appointed on compassionate ground is to be allowed LTC concession only on completion of one year service.
9 What is the entitlement of annual increment to a person appointed as Trainee' on compassionate ground. A Trainee' appointed on compassionate ground, till he/she acquires minimum educational qualification, is allowed increment at normal rates in the pay scale of - 1s.
10 What is the position with reference to reimbursement of Children Education Allowance (CEA) to a person appointed as Trainee' on compassionate ground. A person appointed as Trainee' is allowed Children Education Allowance as per the admissible rates.
11 What is the position with respect to payment of Overtime Allowance (OTA) to a person appointed as Trainee' on compassionate ground.

A person appointed as Trainee' on compassionate ground is not entitled for OTA during the period he/she continue as Trainee'.
12 Whether the dependent of compassionate appointee would be eligible for employment on compassionate grounds since their service in -1S pay band will not be counted as regular service.

A Trainee' has the status of Government Servant from initial day, as such, dependent of a person appointed on compassionate ground as Trainee' would be eligible for compassionate appointment in the event of his/her death in harness.

2. In case of appointment of a widow not fulfilling the requirement of educational qualification, against the post of MULTI TASKING STAFF, she will be placed in Group 'C' - Pay Band - 1 (Rs.5200-20200) + Grade Pay Rs.1800/- directly without insisting on fulfilment of educational qualification norms, provided the appointing authority is satisfied that the duties of the post against which she is being appointed can be performed with help of some on job training. This dispensation is to be allowed for appointment on compassionate ground against the post of MULTI TASKING STAFF only.

Grant of Dearness Relief to Central Government pensioners/family pensioners - Revised rate effective from 01.01.2012

Subject:- Grant of Dearness Relief to Central Government pensioners/family pensioners - Revised rate effective from 01.01.2012.

The undersigned is directed to refer to this Department’s OM No. 42/15/2011-P&PW(G) dated 5th October, 2011 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief (DR) payable to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 58% to 65% w.e.f. 1st January, 2012.

2. These orders apply to

(i) All Civilian Central Government Pensioners/Family Pensioners
(ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates,
(iii) All India Service Pensioners
(iv) Railway Pensioners and
(v) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. in terms of this Department’s OM No. 23/1/97-P&PW(B) dated 23.2.1998 read with this Department’s OM No. 23/3/2008-P&PW(B) dated 15.9.2008.

3. Central Government Employees who had drawn lumpsum amount on absorption in a PSU/Autonomous body and have become eligible to restoration of l/3rd commuted portion of pension as well as revision of the restored amount in terms of this Department’s OM No. 4/59/97-P&PW (D) dated 14.07.1998 will also be entitled to the payment of DR @ 65% w.e.f. 1.1.2012 on full pension i.e. the revised pension which the absorbed employee would have received on the date of restoration had he not drawn lumpsum payment on absorption and Dearness Pension subject to fulfillment of the conditions laid down in para 5 of the O.M. dated 14.07.98. In this connection, instructions contained in this Department’s OM No.4/29/99-P&PW (D) dated. 12.7.2000 refer.

4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

5. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97-P&PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F. No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension, will remain unchanged.

6. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.

7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.

8. The offices of Accountant General and Authorised Public Sector Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, 11/34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Natlonalised Banks.

9. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&AG.

10. This issues with the concurrence of Ministry of Finance, Department of Expenditure conveyed vide their OM No. 1(4)/EV/2004 dated 4th April, 2012.

Enrolments for Aadhaar in Phase-II set to begin this month

The UIDAI is all set to begin its second phase of enrolments for Aadhaar for 40 crore residents in April 2012. A National Level Workshop for Ecosystem partners including Registrars, Enrolment Agencies and other partners were launched at Vigyan Bhavan today.

 Enrolment for Aadhaar is expected to begin gradually across the country and UIDAI hopes to cover 40 crore residents in the coming 2 years with the active support and involvement of its eco-system partners. The Cabinet Committee on UIDAI had approved the continuation of Aadhaar enrolments by Unique Identification Authority of India (UIDAI) through multiple Registrars for an additional 40 crore
residents in January, this year. On this occasion Chairman, UIDAI, Shri Nandan Nilekani encouraged and asked the eco-system partners to actively participate in the next phase of Aadhaar enrolment, in line with the refresh strategy. The DG & MD, UIDAI, Shri RS Sharma highlighted some of the key lessons of the first phase of Aadhaar enrolment and showed the path for the next phase. The workshop was organised to take stock of various aspects of enrolments of Phase I (20 crore residents) and share with the Registrars and other partners, the "refresh strategy" before embarking on the second phase of enrolments. Some of the highlights of the ‘Refresh Strategy’ that were discussed during the workshop were-continuation of enrolment through multi-registrars, sweep approach to cover maximum number of residents of district/State, review of master data for pin code validation, amongst others, identification and training of Verifiers/Introducers by Registrars, on-line appointments for enrolments, setting up of Permanent enrolment stations at District/Taluk level in States/UTs that have covered majority of their population, development of enrolment plans by Registrars and Enrolment Agencies etc. The day long workshop was anchored by Shri Anil Khachi, DDG, UIDAI and he requested the Registrars to launch special social inclusion drives to cover marginalised sections of society.

LIMITED TRANSFER FACILITY TO GRAMIN DAK SEVAKS – CLARIFICATION THEREOF.

Sub:-LIMITED TRANSFER FACILITY TO GRAMIN DAK SEVAKS – CLARIFICATION THEREOF.
This has a reference to your office letter No.ST/120/RLGS/IX, dated 27th Jan 2012 regarding issue of clarification on competent authority empowered to allow limited transfer facility to the Gramin Dak Sevaks in the light of revised instructions concerning powers & functions of Chief Postmaster General/Postmaster General (Region) issued under this Directorate letter No.33-1/88-PE-II dated 05th Dec 1989 read with para 4 of this Directorate letter No.19-10/2004-GDS dated 17th Jul 2006, para 5 of letter No.19-10/2004-GDS (Part) dated 21-07-2010 and in particular the judgement of the Hon’ble CAT, Ernakulam Bench dated 16th Feb 2009 in OA No.286/2008 wherein it was held that the request of the applicant should not have been considered and rejected by the lower functionary.

2. The issue has been examined in this Directorate. As a matter of fact, the issue of extending limited transfer facility to GDS was considered by the Postal Services Board in its 3rd meeting held on 29-06-2006 & it did not agree with the proposal vesting the power for this purpose with the Head of the Region instead approved the proposal restricting the vesting of power only with the HoC. It was thus made clear in para 4 of this Directorate letter No.19-10/2004-GDS dated 17-07-2006 that “power in this regard will vest with the Heads of Circles who will decide each individual case on merit keeping in view the aforementioned criteria and standard of “public interest”. Following recommendations made by Shri RS Nataraja Murti Committee, the issue was considered for certain modifications in this Directorate & it was made clear in para 5 of this Directorate letter No.19-10/2004-GDS (Part) dated 21-07-2010 that “the Heads of Circles are requested to keep the above modifications in view while deciding the case of transfer application of Gramin Dak Sevaks”.
3. In view of the foregoing, I am directed to clarify that the power for the purpose vests only with the HoC & the lower functionaries including Regional PMG are not empowered to consider and reject the requests even in cases where such requests are not covered under the terms and conditions of limited transfer facility. Thereby, the role of the lower functionaries is restricted to receive, verify details and forward such cases with recommendations for consideration of the empowered authority and finally conveying the decision of the empowered authority.  
Further this facility as extended under this Directorate letter No.19-10/2004-GDS dated 17th Jul 2006 & further modified under this Directorate letter No.19-10/2004-GDS(Part) dated 21st Jul 2010 holds good under GDS (Conduct and Engagement) Rules, 2011.
This may be brought to the notice of all concerned for strict compliance.

POSTAL DEPARTMENT PLANS 1000 ATMS IN 6 STATES


The Department of Post (DoP) is on a technology upgrade drive. The department plans to set up 1,000 automated teller machines (ATMs) across six states —Assam, Uttar Pradesh, Rajasthan, Maharashtra, Karnataka and Tamil Nadu — as part of its ongoing modernisation drive, said Manjula Parasher, secretary, posts.
“We will start execution of our modern technology programme across six circles by the end of this year,” said Parasher. “This will help in people getting core banking facility etc. We plan to have 1,000 ATMs in a phased manner. The process for this will start by the year-end.”

The DoP has selected five major technology companies for five of its technology advancement projects.It has issued a Letter of Intent to Infosys for two projects including rural system and financial services integration; Tata Consultancy Services for change management; Sify for network integration and Reliance Communications Infrastructure for data centre.
The department plans to start execution of some of these projects by end of this year across six states on a pilot basis.It has already received approval for Rs 1,877 crore to be spent across these projects over a period of two years and will seek additional funds when the need arises.“Funds of Rs 1,877 crore have been approved,” said Parasher. “We will go ahead with that. We may need more money because implementation in some of the cases may last over six-nine years.”The department will computerise all of its 1.6 lakh post offices across the country by 2013 with over 24,000 department post offices already computerised by March.
250 computerised post offices in J-K
With an aim of providing better services to the people, the DoP has decided to computerise at least 250 post offices in Jammu and Kashmir during the current year. “During this year, the department has taken the ambitious plan of computerising 250 post offices and modernising them to make them relevant,” said John Samuel, chief postmaster general, J&K Circle.
