Registered Letters can't be returned without proper reason: Madras High Court

The postman should make it clear as to whether the registered letter was served on the addressee or refused by the addressee or no addressee was found in the given address, the judge said.
CHENNAI: The Madras high court has frowned on mechanical return of registered letters as "unclaimed" by postmen, and said that in case they could not be delivered, proper reasons must be given.

Justice S Tamilvanan, underscoring the importance of a registered post in litigations and other matters, said that when people pay a fee and affix sufficient postal stamp, the postal authorities or postmen must discharge their duties in a responsible manner. The postman should make it clear as to whether the registered letter was served on the addressee or refused by the addressee or no addressee was found in the given address, the judge said.
Passing orders on a matrimonial litigation, wherein a Chennai-based woman wanted her divorce proceedings to be transferred from a Puducherry court to a Chennai court, the judge said the woman's notice sent by registered post had been returned undelivered with a simple endorsement "unclaimed." Slamming the practice, Justice Tamilvanan said the court was of the view that the reason for the non-delivery of the notice had not been properly explained to the person who sent it.
"The endorsement 'not claimed' is required to be made in a responsible manner by the postman or the official of the postal department, so as to convey proper reason and to bring out the fact as to under what circumstances the registered letter could not be served on the addressee by the postman," the judge said.
In case the registered letter is delivered to a person other than the addressee, the postman must obtain clear endorsement and explain the relationship of the signatory who received the letter on behalf of the addressee, Justice Tamilvanan said.
Return of registered letters with a comment "unclaimed" or with some other improper endorsement would cause inconvenience to the general public and the person seeking justice through court of law, the judge said, adding: "Service of notice by registered post plays a vital role in deciding several cases."
He then directed the chief post-master general of Tamil Nadu to give suitable instructions to all postal department officials to follow the guidelines laid down by the court in this case.

KNOW INDIAN POSTAL ORDER [IPO]

INDIAN POSTAL ORDER

Of late RTI applicants are using Indian postal order [IPO] for paying filing fee and other charges. I append below few rules which will be useful to RTI users:
1. IPOs are available in denominations of Re. 0.50, 1, Rs. 2, 5, 7, 10, 20, 50 and 100/-.

2. Commission per IPO is Re1 to Rs.3 depending upon denomination. For Rs.10 IPO commission is Re.1/-.

3. Value of IPO can be increased by maximum Rs.3/- by affixing unused postal stamps not exceeding 4 on its face. Each stamp should not exceed Re1. Hence, say if you want to pay Rs.12 [and post office does not have denominations below Rs.10, you can buy IPO of Rs.10 and affix two postal stamps of Re.1 [ or 4 stamps of 50 paisa] each on its face. This way IPO will be for Rs.12. This facility of value addition is not applicable to IPO of Rs.100/-.

4. IPO is valid for 24 months from the last date of the month in which IPO is purchased from post office.

5. IPO older than 24 months as above can be revalidated for next 12 months by paying prescribed commission for that denomination of IPO in the form of postal stamps to be affixed on the reverse of IPO.

6. IPO older than 36 months from last day of the month of issue will be forfeited if presented for payment.

7. Purchaser can get refund of IPO within 6 months from last day of month of issue by surrendering original IPO and counterfoil. Purchaser can also get refund after expiry of 6 months from last day of month of issue but before 12 months from last day of month of issue of IPO provided he pays commission for renewal at prescribed rate by affixing stamps on the reverse of IPO to be refunded.

8. In case of loss of IPO, refund can be claimed by submitting counterfoil to Superintendent of Post Offices under whose jurisdiction issuing post office operates. However, refund of lost IPO will not be made before expiry of 36 months from last day of the month of issue of IPO. Claim for lost IPO should be made within 24 months from last day of month of issue. If counterfoil is not available, then number, date and post office of issue should be mentioned in the application for refund.

Employees can't claim VRS benefit as matter of right: Supreme Court

NEW DELHI: No employee, as a matter of right, can seek the benefits of voluntary retirement scheme (VRS) and the decision-taking power lies only with the employer firm, the Supreme Court has held.
"A voluntary retirement scheme introduced by a company, does not entitle an employee as a matter of right to the benefits of the scheme," a bench headed by Chief JusticeAltamas Kabir said.
The bench, also comprising Anil R Dave andRanjana P Desai, said it was "well settled" that only the employer can decide VRS pleas of its employees.
"Whether an employee should be allowed to retire in terms of the scheme (VRS) is a decision which can only be taken by the employer company, except in cases where the scheme itself provides for retirement to take effect when the notice period comes to an end," it said.
The observation came in a verdict by which the apex court rejected the plea of C V Francis, a Kerala resident, that his termination from the post of a manager of Steel Authority of India Ltd (SAIL) at Bokaro in Jharkhand on account of unauthorised absence in 1999 was illegal as he had already applied for the VRS.
"We are not...inclined to interfere with the orders impugned in the Special Leave Petition which is, accordingly, dismissed," the bench said.
Francis, who had taken up an employment in the USA after applying for the VRS, had contended that his plea for VRS came into effect on the expiry of the period of notice as the employer did not take any decision on his plea and hence, it should be construed as deemed acceptance.
Besides seeking VRS, Francis had left to the US after taking leave, but his subsequent leave applications were not accepted.
SAIL termed his subsequent absence as unauthorised and later, initiated disciplinary proceedings leading to his termination from the service.
The single and division bench of the Jharkhand High Court had rejected the plea of Francis on the issue.

Revised Online Transfer Claim Form For EPFO

Union Labour & Employment Minister Shri Sis Ram Ola today released Revised Transfer Claim form for EPFO beneficiaries marking this as first step towards launch of online Transfer Claim facilities here in New Delhi. 
The revised form will have the following salient features: 
• The form will be called Transfer Claim Form instead of Form 13 for easy comprehension by the beneficiaries. 
• The form can be presented after verification, either through the present employer or previous employer. Earlier the form could be submitted after verification only through the present employer. 
• This form can be submitted online as well as in physical form. The facility of online submission of this form will be given shortly after process of collecting the digital signature of the employer is completed. 
• The facility to file physical form shall continue to cater to the needs of working class who do not have internet access. 
• Employee will be allowed to submit their applications online, if their employer is having registered digital signature. 
• Online submission of form will introduce paperless process for claim settlement. 
• Every beneficiary will be informed through SMS and e-mail about the stage of process of the claim to make the entire process transparent and accountable. 
• After introduction of online claim settlement, endeavour will be made to substantially reduce the assured time of settlement of transfer claim which presently is 30 days. 
Secretary LEM, Dr. Mrutyunjay Sarangi, Shri K.K. Jalan, CPFC and other senior officers of EPFO were also present on the occasion. Dr. Mrutyunjay Sarangi directed that the guidance and directions given by Hon’ble Minister should be adhered to by EPFO. 
On this occasion the Minister also reviewed the working of EPFO. In his review Minister emphasized that EPFO must adhere to the Strategic Plan of Ministry of Labour & Employment for next five years. The plan visualizes development of system for Web based services to employers and employees for online submission of forms and settlement of claims. The Minister noted that timely settlement of claims has been the rightful expectation of the beneficiaries of Employees’ Provident Fund. In the financial year 2012-13, 107.62 lac number of claims were settled out of which 88% of claims were processed within 30 days which is the current time frame for settlement of claims. 
Though the percentage of claim settled in time is high in absolute terms approximately 13 lac number of beneficiaries did not get their settlement of claims within the stipulated time. Minister directed that all efforts should be made to not only settle the claims within time but also to reduce the time taken in settlement of claims.

I-T dept may make d-o-b proof mandatory for PAN card

NEW DELHI: As part of its drive against fake Permanent Account Number, the Income Taxdepartment is considering making proof of date-of-birth mandatory for issuance of PAN card. 
"The department might ask for proof of date-of-birth for issuing a PAN card. Ration cards and rent receipts might no longer be accepted as proofs of identity and address for issuance of a PAN card," sources in the finance ministry said. 
According to officials, in most cases of fraud, people have furnished fake ration cards and rent receipts to get PAN card. 
As of now, depository account statement, bank account statement /passbook, ration card, passport, voter identity card, driving licence, property tax assessment order and certain other documents are accepted as proof of identity as well as address. 
"We will soon prescribe a format for PAN verification to make the system foolproof and robust," sources said. 
The sources further said that a notification regarding streamlining process of PAN verfication will be issued soon and it will apply only to fresh applicants. 
Recently, the I-T department has found a number of individuals possessing fake PAN cards as identity proof. 
According to the official data, 170 million people in India have PAN cards, while only 30 million of them file income tax returns. 
Many people who do not file tax returns get PAN card as it works as identity proof at many places. 
The finance ministry had last year brought out a new PAN application form-- 49A for use of Indian citizens, companies and entities incorporated in the country which allows a applicant to mention his or her Aadhaar number.
