Small Family Norms – Concessions for Central Government Employees



Small Family Norms – Central Government Employees are entitled for Family Planning Allowance as well as Rebate on House Building Advance (HBA)


We all know Government is promoting Small Family Norms in order to control population. As per the present norms a family consists of not more than Two children is said to be a small family.

As such Central Government Employees are entitled to certain concessions for maintaining small family norms. Government is also restricting certain Concessions, allowances, reimbursements etc., to Central Government Employees up to two children only. The concessions / Allowances / reimbursements such as Leave TravelConcession, Children Education Allowance, Child Care Leave etc would fall under this category.
Let us have a look at the Concessions / incentives applicable to Central Government Employees for undergoing Sterilization Operation in order to maintain small familynorms.

(i) Family Planning Allowance varying from Rs.210/- to Rs.1000/- per month based on Grade Pay of employee
(ii) A rebate of 1/2% (0.5%) from the applicable interest on House Building Advance in the case of employee availing HBA.

General Conditions for grant of Family Planning Allowance and Rebate on HBA:

1. Having one surviving Child prior to undergoing Family planning procedure(Sterilization Operation) is a must to avail concessions.

2. As far as the condition based on age of the employee is concerned, the following table gives necessary details.
Gender of Employee
Age of Employee and Spouse
Male Employees
His Age should be 50 years or less than 50 years. The Age of Employee’s Wife should be between 20 and 45 years
Female Employees
Her Age should be 45 years or less than 45 years. The Age of Employee’s husband should be 50 years or less than 50 years



2. Similarly, prior to family planning procedure the employee should not have more than two children.

3. When Family planning procedure is not successful viz., Government Employee / spouse is getting pregnant due to failure of Sterilization operation, the government employee will not be entitled to any incentive from the date of pregnancy.

4. A Certificate in the prescribed form is to be given by the hospital authorities which is performing family planning procedure (sterilization operation) to the effect that Family Planning procedure was completed in respect of the employee or his / her spouse.

5. In the case of Family Planning procedure done by a private hospital, a civil surgeonor DMO or AMA or a Medical Officer of CGHS should counter sign the form signed and certified by the private hospital to the effect that Family Planning procedure was completed in respect of the employee or his / her spouse.

Relaxation of certain Conditions for grant of Family Planning Allowance and Rebate on HBA:

1. Either the government employee or his / her spouse can undergo Sterilizationoperation in order to maintain small family norms.

2. In the case of birth of twin children after giving birth to one surviving Child, all concessions under Small Family Norms granted to employee would be allowed if the said employee / spouse is undergoing for sterilization operation, since giving birth to twinbabies in the second birth is beyond the control of the employee to maintain small familynorms.

3. Normally, recovery of concessions availed would be ordered in the case of failure ofSterilization operation. However, concessions under small family norms will be provided again when employee / spouse is undergoing family planning procedure again subject to fulfillment of conditions under small family norms.

4. In respect of rebate on HBA, Government allows such rebate even when an employee is undergoing Family planning procedure (sterilization operation) after receipt of first installment of HBA but before receipt of final installment of HBA.

Note: Family Planning Allowance will be fixed based on Grade Pay of Employee which he / she is drawing at the time of Family Planning Procedure. This family planning allowance will remain unchanged during the service of employee unless there is a revision in Family Planning Allowance by Government.

Certain Clarifications by Government regarding Rebate on HBA in Office Memorandum No: I/17015/13/79-H-III dated 31.03.1981

1. Query: Whether Rebate on HBA could be availed by persons who have not undergone sterilization but have limited their families through other means.
Clarification : No. Employees or his / her spouse who have undergone Sterilization procedure and fulfilling small family norms will only be entitled for Rebate on HBA.

2. Query : Whether Cases of hysterectomy (surgical removal of Uterus) will be entitled for rebate on HBA as a woman who undergoes hysterectomy on medical grounds automatically gets sterilized.
Clarification : Such cases are not entitled for rebate on HBA as hysterectomy is a purely health measure.

3. Query : Whether Rebate on HBA would be applicable to Persons who have had twins after birth of their first two children should be eligible for receiving the incentives although they have 4 children.
Clarification : Yes. Such employees will be entitled for Rebate on HBA.

Amendment to SC and ST (POA) Act



The Act is implemented by respective State Governments and Union Territory Administrations. With a view to ensure its effective implementation, following steps are taken by the Ministry:-

(i) Central assistance is provided to States/Union Territories, inter-alia, for:-

(a) strengthening the enforcement and judicial machinery,

(b) relief and rehabilitation of the affected persons, and

(c) awareness generation.

(ii) Central Government has, by notification dated 23.12.2011, amended rules under the PoA Act and effected an increase -generally of 150% - in the minimum scale of relief for victims of various types of atrocities.

(iii) A Committee constituted, in 2006, under the Chairpersonship of the Union Minister for Social Justice and Empowerment, has so far held twenty meetings wherein implementation of the Act in 24 States and 4 Union Territories has been reviewed. Important points emerging from the review are followed up with State Governments. (iv) Offences under the PoA Act are reviewed, inter-alia, in the Conference of Ministers/Secretaries in charge of Social Justice /Welfare, organized by the Ministry every year.

(v) The more heinous crimes reported in the media are followed up with the State Governments for effective action.

(vi) Dr. Ambedkar Foundation, an autonomous organization under this Ministry, also implements a Scheme to provide relief to SC victims of heinous crimes.

(vii) Awareness generation about the provisions of the Act.

The Ministry had invited considered views of concerned Ministries, State Government/Union Territory Administrations and concerned agencies regarding amendments in the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities){PoA} Act, 1989. A Committee under the Chairpersonship of Additional Secretary in the Ministry with members from concerned Central Ministries/State Governments had been constituted in August, 2012, for further considering the matter. The Committee held three meetings, and submitted its report after third meeting on 15.03.2013. Besides it, Union Minister for Social Justice & Empowerment held consultation meetings with concerned Ministers of State Governments, and eminent persons on 20.02.2013 and 14.03.2013, respectively. The Government has, thus, commenced the process to consider amendments in the PoA Act.

Subject : Electronic Indian Postal Order — launching of.
On the initiative of Department of Personnel and Training, Department of Posts has launched a service called "elPO (Electronic Indian Postal Order) w.e.f. 22.03.2013. This is a facility to purchase an Indian Postal Order electronically by paying a fee on-line through e-Post Office Portal i.e.http://www.epostoffice.gov.in. It can also be accessed through India Post website www.indiapost.gov.in . As per RTI Rules, 2012, fees may be paid by electronic means, if facility for receiving fees through electronic means is available with the public authority.
2. At present, this facility is provided only for Indian Citizens abroad across the globe to facilitate them to seek information from the Central Public Information Officers (CPIOs) under the RTI Act, 2005, Debit and Credit cards can be used to purchase elPO.
3. The user needs to get himself registered at the website. He has to select the Ministry/Department from whom he desires to seek the information under the RTI Act and the elPO so generated can be used to seek information from that Ministry/Department only. A printout of the elPO is required to be attached with the RTI application. If the RTI application is being filed electronically, elPO is required to be attached as an attachment.
4. It may be noted that this facility is only for purchasing an Indian Postal Order electronically. All the requirements for filing an RTI application as well as other provisions regarding eligibility, time limit, exemptions etc., as provided in the RTI Act, 2005 will continue to apply.
5. An elPO so generated must be used only once with an RTI application. To check any multiple use of the same elPO, the CPIOs shall maintain a record of the elPOs so received from Indian Citizens abroad. In case of any doubt, the details of elPO can be verified from the above mentioned site/portal of India Post.
